These Terms & Conditions (“Terms”) govern your access to and use of the TowardsNorth India website, enquiry forms, and related services (“Platform” / “Services”). By using the Platform or submitting an enquiry, you agree that you have read, understood, and are bound by these Terms. If you do not agree, please do not use the Platform.
1. Definitions
- “TowardsNorth India” / “we” / “us” / “our” refers to the business operating this website and services.
- “User” / “you” refers to any person visiting the Platform or submitting an enquiry.
- “Project” refers to home construction, interiors, renovations, or any related scope discussed with us.
- “Agreement” refers to the formal written contract executed for a Project (if applicable).
2. Scope of Services
TowardsNorth India provides consultation, planning support, project execution (construction/interiors), and coordination as agreed in writing. Any information shared on this Platform is general in nature and does not constitute a binding offer unless stated in a formal quotation and/or Agreement.
3. Enquiries, Consultation & Quotations
- Submitting an enquiry does not create a contract between you and TowardsNorth India.
- Consultations, estimates, and quotations are based on inputs available at the time and may change due to site conditions, design iterations, approvals, material selections, or scope changes.
- Final pricing, timelines, inclusions/exclusions, and deliverables are confirmed only through a written quotation and/or Agreement.
4. Project Execution Principles
Our execution approach may include (as applicable): scope definition, stage-wise milestones, supervision, quality checks, and finishing/punch-list closure. The exact process depends on the Project type and the Agreement executed.
5. Client Responsibilities
- Provide accurate information about plot details, site access, requirements, and expectations.
- Share documents required for approvals/permissions/loan processing (where applicable) in a timely manner.
- Respond to design approvals, selections, and decisions without undue delay to avoid timeline impact.
- Make payments as per the agreed schedule/milestones in the Agreement.
6. Permits, Approvals & Compliance
Approvals and permits are subject to authority timelines, documentation completeness, and compliance. While we may assist in coordination, final approvals are issued by the relevant authorities and are outside our control. Any delay due to authorities, documentation, or third parties may affect the overall timeline.
7. Payments
- Payment terms, schedules, and milestones are defined in the quotation/Agreement.
- Unless explicitly agreed otherwise, payments are made via bank transfer/UPI/other approved methods.
- Non-payment or delayed payment may pause work, impact delivery timelines, and may attract charges as per the Agreement.
8. Changes, Variations & Additional Work
Any change requested by you after scope finalization may be treated as a variation/additional work. Variations may impact cost and timeline and will be executed only after written confirmation (email/WhatsApp/written variation order, as applicable).
9. Cancellation & Suspension
Cancellation and suspension terms are governed by the signed Agreement (if applicable). If no Agreement exists, we may stop providing Services at our discretion in cases of misuse, non-cooperation, or non-payment.
10. Warranty & Defect Liability
Warranty/defect-liability (if any) is governed by the written Agreement and specific scope. Warranty does not cover normal wear and tear, misuse, unauthorized modifications, or issues caused by third-party interventions.
11. Intellectual Property
All content on the Platform—including text, designs, visuals, branding, and layout—belongs to TowardsNorth India or its licensors. You may not copy, reproduce, or reuse it without prior written permission.
12. Platform Usage Restrictions
- You will not attempt to gain unauthorized access to the Platform, server, or systems.
- You will not upload or transmit harmful, illegal, defamatory, or misleading content.
- You will not use automated tools (bots/scrapers) to collect data from the Platform.
13. Communications & Consent
By submitting your details, you authorize us to contact you via calls, WhatsApp, SMS, and email for consultation, project communication, and service updates. Where required, you may opt-out of marketing communication by contacting us.
14. Referral & Rewards Terms (if applicable)
We may run referral programs from time to time (“Referral Program”). Participation is optional and subject to these terms and any program-specific updates communicated by us.
14.1 Benefits for Referee (Person getting referred)
- The referred person (“Referee”) may receive an offer/benefit as communicated at the time of referral.
- Eligibility for any referee benefit may be linked to a milestone such as booking confirmation or an initial payment (e.g., 5% of project value), whichever occurs earlier, if stated in the program.
- Benefits are not transferable and may have a validity period.
14.2 Benefits for Referrer (Person who refers)
- The referrer is eligible for cashback/reward only on successful conversion as defined by the Referral Program.
- “Successful conversion” generally means the referred Project has reached a defined milestone (for example, booking confirmed AND execution commenced). The exact milestone will be communicated by us for that program.
- Cashback/reward is processed within a stated timeframe after successful conversion (for example, within 2 weeks), subject to verification.
- Rewards are paid via direct bank transfer only to the referrer’s verified account.
- Multiple offers may not be clubbed unless explicitly stated.
- TowardsNorth India reserves the right to modify, pause, or discontinue the Referral Program at any time.
14.3 Referral cashback slab (sample structure)
The following table is a typical structure. Final slabs and payout rules may vary per program and will be communicated at the time of referral.
- Project Value < ₹30 Lakhs — Referral Amount: ₹15,000
- ₹30–₹40 Lakhs — Referral Amount: ₹20,000
- > ₹40 Lakhs — Referral Amount: ₹25,000
15. Disclaimers
- The Platform is provided on an “as is” and “as available” basis.
- We do not guarantee that the Platform will be uninterrupted or error-free.
- Any timelines mentioned on the Platform are indicative unless confirmed in writing.
16. Limitation of Liability
To the maximum extent permitted by law, TowardsNorth India shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or reliance on any information shared on the Platform. Our liability, if any, is limited as per the Agreement and applicable law.
17. Indemnity
You agree to indemnify and hold harmless TowardsNorth India, its team, and affiliates from any claims, damages, liabilities, and expenses arising out of your misuse of the Platform, violation of these Terms, or infringement of third-party rights.
18. Modification of Terms
We may revise these Terms from time to time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
19. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Subject to applicable law, courts in Pune, Maharashtra shall have jurisdiction over disputes arising out of these Terms or the Platform.
